Minimum Advertised Price (MAP) Policy
World Emblem | Hero’s Pride | Custom Genie
Effective: 10/30/2026
This Minimum Advertised Price Policy is issued by World Emblem International, Inc., Hero’s Pride, Inc., and Custom Genie, Inc. (each, for products sold under its own brand, “Seller”). It is published in Seller’s dealer resources and on the World Emblem, Hero’s Pride, and Custom Genie websites. It is separate from, and not part of, Seller’s Sales Terms and Conditions or any other agreement.
(a) Purpose.
Seller has invested substantially in the design, quality, and reputation of its products and in a network of Resellers that provide knowledgeable sales support, fitting, and service to retailers. When Seller’s products are advertised at deeply discounted prices, it erodes the value of Seller’s brands, undermines Resellers’ ability to invest in that support, and can cause end users to question product quality. To protect these interests, Seller has adopted this Minimum Advertised Price Policy (the “MAP Policy”).
(b) Unilateral Policy; No Agreement.
This MAP Policy is a unilateral statement of the conditions under which Seller is willing to do business. Seller alone decides these conditions.
- This MAP Policy is not an agreement. Seller does not request, require, or accept any agreement, assurance, or acknowledgment of compliance from any Reseller. Seller does not ask any Reseller to sign, accept, or acknowledge this MAP Policy.
- This MAP Policy is not part of Seller’s Sales Terms and Conditions, any purchase order, or any Distributor, Dealer, or Channel Agreement. Placing an order or buying products from Seller is not an agreement to comply with it.
- Seller will not negotiate, discuss, or modify this MAP Policy with any individual Reseller.
- No employee, sales representative, or agent of Seller has authority to waive or modify this MAP Policy, to grant exceptions, or to enter into any agreement about resale or advertised prices. Any exception is void unless an officer of Seller issues it in writing and makes it available on the same terms to all similarly situated Resellers.
- Each Reseller remains free to set its own resale prices and to decide independently whether to advertise below MAP. Seller remains free to decide independently whether to do business with that Reseller.
(c) Definitions.
- “Advertised Price” means the lowest price at which a MAP Product is displayed or offered in an Advertisement, or the lowest price that can be inferred from it. It is calculated after any advertised discount, coupon, promotional code, rebate, bundle, or other incentive.
- “Advertisement” means any communication, in any medium, that displays or conveys a price to the public, or to anyone other than a specific customer in a one-to-one communication. This includes, without limitation:
- Reseller websites and web stores, including product, category, and search-results pages, quick-view windows, hover or mouse-over displays, and pop-ups;
- third-party marketplaces;
- comparison-shopping engines, search-engine shopping ads, and product data feeds;
- social media posts, ads, live streams, and social-commerce shops;
- email and SMS campaigns and newsletters;
- mobile apps;
- printed catalogs, flyers, circulars, mailers, and signage;
- radio, television, and streaming ads;
- trade-show and event materials directed to the public.
- “Business Day” means any day other than Saturday, Sunday, or a US federal holiday.
- “MAP Price” means the minimum advertised price for each MAP Product shown on the MAP Price List. Unless the list states otherwise, the MAP Price is per single unit and excludes taxes and shipping.
- “MAP Products” means the products listed on Seller’s then-current MAP price list for the applicable brand (the “MAP Price List”), as posted in Seller’s dealer resources or otherwise provided by Seller. Custom and made-to-order products are not MAP Products unless the MAP Price List names them specifically.
- “Reseller” means any person or entity that resells MAP Products, whether it bought them directly from Seller or from a distributor authorized by Seller.
(d) Scope.
This MAP Policy applies:
- to all Resellers, in all Advertisements of new MAP Products, in every medium and channel, subject to the United States limitation below;
- to a Reseller’s affiliates, and to anyone acting on a Reseller’s behalf, including agents, contractors, marketing agencies, affiliate marketers, and the providers of any automated pricing tool the Reseller uses;
- to all Advertisements displayed on or after the date this MAP Policy is first posted on Seller’s website, including Advertisements first published before that date.
United States only.
This MAP Policy applies only to Advertisements directed to purchasers in the United States. It does not apply to Advertisements directed to purchasers in Canada, the United Kingdom, Mexico, or any other country outside the United States. Seller does not apply this MAP Policy, and takes no action under it, with respect to any Reseller’s advertising, pricing, or supply outside the United States.
(e) Practices Seller Treats as Advertising Below MAP.
Seller treats each of the following as an Advertised Price below MAP. The list is not exhaustive.
- Displaying a price below MAP anywhere in an Advertisement, including in product feeds, structured data, or page metadata.
- Strikethrough, “was/now,” or “compare at” presentations that display a price below MAP.
- Advertising a percentage-off discount, dollar-off discount, coupon, promotional code, or automatic cart discount that applies to a MAP Product and would bring its price below MAP. This includes site-wide and category-wide promotions that do not expressly exclude MAP Products.
- Requiring or inviting a customer to add a MAP Product to a cart, sign in, create an account, join a membership program, or provide an email address in order to see a price below MAP.
- Advertising a MAP Product in a bundle, kit, or package at a combined price lower than the total of: (i) the MAP Prices of the MAP Products in it; plus (ii) the Reseller’s regular advertised prices for the other items in it.
- Advertising free or discounted products, gift cards, store credit, or anything else of value tied to the purchase of a MAP Product.
- Advertising rebates, cash back, loyalty points, rewards multipliers, or similar incentives specific to MAP Products that effectively reduce the price below MAP.
- Advertising that the Reseller will pay the sales tax on MAP Products, or running “tax-free” promotions on MAP Products.
- Statements that state or imply that a price below MAP is available. Examples include “too low to show,” “below MAP,” “we’ll beat any price,” “email us for a lower price,” and price-match offers that cover MAP Products.
- Repricing software, dynamic pricing, or marketplace automatic-pricing settings that cause an Advertised Price to fall below MAP, even temporarily.
- Sending a below-MAP price by email, text, or message to a customer list, group, or subscriber base, or in any communication other than a one-to-one communication with an individual customer.
- Using a different business name, storefront, affiliate, related entity, or third party to advertise below MAP.
(f) Permitted Practices.
None of the following is a violation of this MAP Policy:
- Advertising a MAP Product at or above its MAP Price.
- The price a Reseller actually charges for a MAP Product. This includes a price quoted in person, by telephone, or in a one-to-one written reply to a specific customer’s inquiry. None of these is an Advertised Price.
- Responding to a request for proposal, request for quotation, bid, or quote request from a government agency, department, or institutional purchaser, as long as the pricing is not published to the general public.
- Pricing that a Reseller is legally required to publish under an awarded government contract, or pricing the Reseller offers under an awarded government or cooperative purchasing contract.
- Displaying pricing in a password-protected portal for a specific agency or institutional customer under negotiated contract pricing, provided the portal is not open to public registration.
- Offering free or discounted shipping.
- Using neutral statements such as “Call for price,” “Email for price,” or “Contact us for agency pricing,” as long as they do not suggest a below-MAP price is available.
- Running store-wide promotions that expressly exclude MAP Products, where the exclusion is clearly disclosed and actually applied at checkout.
- Showing prices on in-store tags and displays inside a Reseller’s physical retail location, if they cannot be seen from outside the store.
- Clearing out discontinued products after Seller notifies Resellers that those products are no longer subject to MAP.
(g) MAP Price List Changes; Promotional Periods.
Seller may at any time change MAP Prices, and may add products to the MAP Price List or remove them from it. Seller will try to give at least ten (10) days’ notice of any MAP Price increase. MAP Price decreases and removals of products from the MAP Price List may take effect immediately. Seller may announce, in writing, promotional periods during which specified MAP Prices are temporarily reduced or suspended. Any such promotional period applies equally to all Resellers. When it ends, the regular MAP Prices apply again. Discontinued products remain subject to this MAP Policy until Seller gives notice that they have been removed from the MAP Price List.
(h) Monitoring.
- Seller monitors Advertisements through its own personnel and through third-party monitoring services.
- A dated screenshot, capture, or record collected by Seller or its monitoring service is sufficient evidence of an Advertisement for purposes of this MAP Policy.
- Seller’s determination of whether a violation has occurred is final.
- A Reseller is responsible for every Advertisement made by it or on its behalf. This applies whether the below-MAP price resulted from an error, a software or repricing tool, a marketplace’s automatic action, an agency, or an affiliate.
(i) Seller’s Response to Violations.
If Seller determines that a Reseller has advertised a MAP Product below its MAP Price, Seller may take any action it considers appropriate, in its sole discretion. Seller may act at any time, in any order or combination, and without first giving notice or taking any lesser step. Seller’s possible actions include, without limitation:
- stopping all sales of Products to the Reseller, temporarily or permanently;
- suspending order acceptance or shipments of MAP Products, or of all Products;
- canceling outstanding orders and changing credit terms, as Seller’s Sales Terms and Conditions allow;
- suspending or ending the Reseller’s eligibility for discount, rebate, and cooperative-advertising programs;
- removing the Reseller from Seller’s dealer locator and retail-location listings; and
- revoking the Reseller’s authorized status and its permission to use Seller’s trademarks and images.
Seller may, but is not required to, send a written notice identifying an Advertisement. Any notice is for information only. It does not ask the Reseller to respond, take any action, or give any assurance. Seller’s decision not to act on a violation does not limit its right to act on that violation or any later one.
Seller’s decisions under this section are final and are not subject to negotiation. Seller does not invite reinstatement requests, and does not ask for or accept promises of future compliance or other assurances from any Reseller. Seller alone decides whether and when to resume doing business with a Reseller.
(j) Use of Seller Trademarks and Content.
Any permission for a Reseller to use Seller’s names, trademarks, logos, product images, descriptions, or videos in Advertisements is a limited, non-exclusive license that Seller may revoke at any time. Seller may revoke that permission for any Reseller that violates this MAP Policy, and that Reseller must then remove the revoked materials within five (5) Business Days.
(k) Reports of Violations.
Resellers may report suspected violations to Seller in writing. A report should include a screenshot, the URL or location of the Advertisement, and the date. Seller reviews each report and acts independently. Seller will not discuss with any Reseller its pricing decisions about, or its enforcement against, any other Reseller. Seller will not take part in, accept, or act on any agreement among Resellers about prices. Resellers should not communicate with one another about pricing.
(l) Relationship to Other Terms.
- This MAP Policy applies to all Resellers, including Resellers that are parties to a Distributor, Dealer, or Channel Agreement.
- This MAP Policy is in addition to the “No Unauthorized Resale of Products” section of Seller’s Sales Terms and Conditions. Nothing in this MAP Policy authorizes sales on third-party marketplaces. A Reseller that lists MAP Products on a third-party marketplace without Seller’s written authorization violates that section, whatever the listed price.
(m) Modification; Questions.
Seller may modify, suspend, or discontinue this MAP Policy at any time, either by posting a revised version on its website or by giving written notice to Resellers. Questions about this MAP Policy may be sent to the order email address for the applicable brand: help@worldemblem.com (World Emblem), info@herospride.com (Hero’s Pride), or info@customgenie.com (Custom Genie). Seller’s personnel will explain what this MAP Policy says. They will not discuss any Reseller’s pricing intentions, or anyone else’s, and will not ask for any commitment about pricing.
